Terms and Conditions 2023

For the Praxisforum Geothermie.Bayern 2023 from October 10 to 12, 2023, the following General Terms and Conditions of Enerchange GmbH & Co. KG, Tizianstr. 96, 80638 Munich, which is responsible for the implementation of the Praxisforum Geothermie.Bayern (i. F. Conference).

 
1. CONCLUSION OF CONTRACT

1.1 The participant may register via an online registration form, by letter, fax, email or by telephone. In the case of online registration, a binding registration for the presented event is declared by clicking on the button "Register with costs". Confirmation of receipt of the registration is sent by automated e-mail immediately after sending the registration and does not constitute acceptance of the contract.

1.2 With the registration the validity of these conditions of participation is accepted.

1.3 The registration is confirmed by sending an invoice (by e-mail or mail) to the billing address provided and becomes legally binding. In principle, registrations will be considered in the order in which they are received.

1.4 Entitlement to participate in the Praxisforum Geothermie.Bayern is subject to receipt of payment of the participation fee. In the case of registration shortly before the start of the conference, payment can also be made by credit card (+ additional charge of 5%) on location.

1.5 If a registration cannot be considered by the host, this will be communicated immediately.

1.6 The host and participants agree to comply with the current legal health regulations.

 

2. SERVICES

At the price valid at the time of registration, the participant acquires the right to attend the conference including catering during the booked events. The organizer will provide a varied conference program as far as possible. Program changes are also possible at short notice.The presentations will be made available digitally in the first two weeks after the event, depending on the release by the speakers.The access data to the password-protected website will be sent by e-mail to the address given during registration.

 
3. FEES

The conference fees for the Praxisforum Geothermie.Bayern 2023 are as follows:

► Representatives of municipalities, authorities and municipal associations as well as students enrolled at a university (with proof) are entitled to a reduced price until October 4, 2023. The reduced price cannot be combined with other discounts and reductions.

► All prices include the currently applicable statutory value-added tax. The statutory value-added tax is also payable by international participants due to legal requirements.

► These discounts are only valid for payment up to two weeks after receipt of invoice.

 
4. INVOICING AND PAYMENTS

The registration fee is due upon receipt of the invoice prior to the start of the event. A processing fee of 50 EUR will be charged for invoice corrections due to incorrect information provided during registration.Additional work for further documents that have to be filled in or provided will be charged at an hourly rate of 100 EUR according to time and effort.

The invoice amount is to be paid by bank transfer, quoting the invoice number. Discounts expire with a delay in payment of more than one month after the invoice date.

 

5. WITHDRAWAL OF THE PARTICIPANT

5.1 The consumer's right of withdrawal (see Section 6) exists in addition to the right of withdrawal regulated below.

5.2 Withdrawal from the event is possible. Cancellation costs of 100 euros will be charged for a withdrawal up to September 26, 2022. Cancellation costs will be applied from the date of invoice dispatch.For cancellations after September 27, 2022, the full invoice amount must be paid.5.3 Cancellation must be made in writing. The relevant date for meeting the deadline is the date of receipt of the notice of withdrawal by the organizer.5.4 Cancellation of the contract after the start of the event is not possible.

5.5 The nomination of a substitute participant is possible, provided that the nomination is received by September 26, 2022.Otherwise, a processing fee of 100 euros will be charged.

 
6. REVOCATION BY THE CONSUMER

Consumers in the sense of § 13 BGB (German Civil Code) have a right of withdrawal in addition to the withdrawal regulation in item 5 (download withdrawal policy with withdrawal form):

Consequences of revocationIn the event of an effective revocation, the services received by both parties shall be returned and any benefits derived (e.g. interest) shall be surrendered. If you are unable to return or surrender the received performance and benefits (e.g. benefits of use), or are only able to do so in part or in a deteriorated condition, you must compensate us for the loss of value.

This may mean that you must nevertheless fulfill the contractual payment obligations for the period until revocation. Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation, for us with its receipt.

7. CANCELLATION AND MODIFICATION OF EVENTS BY THE HOST

7.1 The event may be canceled by the host for good cause, in particular due to a lack of a sufficient number of participants to cover costs or due to force majeure.The participant shall be informed immediately and any fees already paid shall be refunded in full.Further claims are excluded subject to section 9.

7.2 The host is entitled to change speakers or to postpone the schedule for good cause, e.g. due to cancellation of the speaker, insofar as this is reasonable for the participant.

7.3 The host may adjust, shorten or cancel individual events depending on the number and interest of the participants and on the number of advance registrations. Changes to the event program or cancellation of speakers shall not constitute grounds for a claim for reimbursement of the conference fee, in whole or in part.

 
8. CANCELLATION BY THE HOST

The host may terminate the contract with a participant for good cause, e.g. if the participant persistently disrupts the event or if no payment is made in due time in response to a reminder. A claim for reimbursement of already paid fees does not exist.

 

9. LIABILITY

 The host shall only be liable for damages resulting from an intentional or grossly negligent breach of duty on the part of the organizer, its legal representatives or vicarious agents. This shall not affect liability for injury to life, limb and health, for breach of essential contractual obligations and under the Product Liability Act. Essential contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract and on whose compliance the contractual partner relies and may regularly rely.In case of violation of essential contractual obligations, the claim for damages is limited to the typically foreseeable damage, if this damage was not caused intentionally or by gross negligence, unless it concerns claims for damages resulting from injury to life, body or health.

No liability is assumed for COVID-19 infections during the congress. The host together with his partners commits himself to comply with the official regulations.

 
10. DATA PROTECTION

The data of the participant and/or the contracting party or its representative will be electronically stored and automatically processed by the host exclusively for the purpose of conducting the Praxisforum Geothermie.Bayern, unless express permission is given for other use and/or utilization of the data as specified in the respective consent. The use also includes the forwarding of the data to third parties covered by the permission. The data will not be passed on to unauthorized third parties. Confirmation of participation may also be sent by unencrypted e-mail. In this case, it cannot be ruled out that it will be read by third parties.

The participant's data will be used after the event for advertising and marketing purposes for future events.

 

11. Copyright

Working documents and computer software used are protected by copyright. Copying or passing on to third parties is only permitted with the prior consent of the copyright holder and host.

 

12. IMAGE RIGHTS

Within the scope of the Praxisforum Geothermie.Bayern, a photographer has been commissioned to take pictures. In addition, the event will be recorded with images and sound. The images will be used after the event for advertising and marketing purposes for future events. According to §23 KUG, this is also permitted for pictures of people participating in public events. If you nevertheless do not agree with a publication, we ask you to inform us in writing.

 

13. TERM OF CONTRACT

The term of the contract begins on the first day of the event and ends on the last day of the event (= minimum contract term).

 

14. SEVERABILITY CLAUSE

In the event that individual clauses of these terms and conditions are invalid, the validity of the remaining clauses shall remain unaffected.
